We require a signed contract before commencing any project.

We do not accept made-for-hire terms or contracts that deny the artist the opportunity to negotiate terms.

We do not accept all rights terms (or buyouts) that transfer ownership of our work without fair compensation.

We do not work on speculation or provide free work with the promise of potential future payment.

Our studio has a minimum project value requirement; please contact us for more information.

We do not provide estimates on the spot; we require time to review the project scope and provide an accurate quote.

PAYMENTS & DEPOSITS

A 50% deposit of subtotal is due before the initiation of services. This 50% deposit is non-refundable. By paying this deposit you acknowledge the nature of the deposit and approve the initiation of these services.

THIRD-PARTY FEES

Estimates and invoices may not include additional resources, including but not limited to hosting, plug-ins, domain registration, and other third-party fees. These fees will be paid later, directly to those parties by the client, and are the sole responsibility of the client.

ADDITIONAL LABOR

Additional labor discussed outside of the scope of the provided invoices and estimates is not covered unless a separate estimate is accepted by both parties, a deposit is made by the client, and a contract is signed by both parties.

We reserve the right to delay signing a contract if necessary, to ensure that all terms are agreeable.

We reserve the right to refuse the terms of a project or contract if they do not align with our policies or values.

Banks Graphic Design LLC retains the ownership rights to the designs we create except in the event of a copyright sale. Typically our clients are granted liberal usage rights limiting revisions to our designs without our prior written consent and approval.

We reserve the right to use any of our work created for clients for marketing and promotional purposes unless a non-disclosure agreement (NDA) is in place.

NON-DISCLOSURE AGREEMENTS

If an NDA is signed, we will not use the work for marketing or promotional purposes without explicit permission from the client or the expiration date of the NDA.

All documents produced by Banks Graphic Design LLC and information disclosed within, including the document structure and contents, are confidential and the proprietary property of Banks Graphic Design LLC. Any disclosure to a third party in whole or in part in any manner is expressly prohibited without the prior written permission of Banks Graphic Design.
